This Independent Affiliate Agreement (“Agreement”) is entered into between Tides Peptides (“Brand”) and the participating Affiliate/Influencer (“Influencer”).

1. Engagement

The Brand appoints the Influencer as a non-exclusive affiliate partner to promote the Brand’s products through social media and digital content.

2. Compensation

The Influencer will earn commission on Net Sales generated through their unique affiliate code or link within a 30-day attribution window, based on the structure they choose. If the Influencer chooses the 15% commission option, they will earn 15% of Net Sales per order. If they choose the 0% commission option, they will not earn a commission, and the full 30% will go to the follower discount.
“Net Sales” means the total sales amount, excluding discounts, refunds, taxes, and shipping.
Commissions are paid monthly.
The Influencer will receive complimentary product(s) for content creation purposes after successful sign up.
The Influencer will also receive 1–2 complimentary products per month as long as they remain an “Active Affiliate.”
An “Active Affiliate” is defined as an Influencer whose unique affiliate code or link generates a minimum of two (2) completed orders per month. If the Influencer does not meet the monthly activity threshold, complimentary product eligibility may be paused until activity resumes.

3. Obligations

The Influencer agrees to create authentic, original, and brand-aligned content.
The Influencer must disclose their partnership per FTC guidelines (e.g., “#ad” or “Paid partnership with Tides Peptides).
The Influencer may not make medical, therapeutic, or dosage-related claims.
All content must be submitted for Brand review and approval prior to posting.
The Influencer may not run paid ads using the Brand’s name or likeness without written consent.

4. Content Usage Rights

The Brand may repost or share the Influencer’s approved content on its official platforms with proper credit.
The Brand may not materially alter content without prior written approval from the Influencer.

5. Confidentiality

The Influencer agrees to keep all non-public information shared by the Brand (including commission details, affiliate data, and marketing materials) strictly confidential.

6. Termination

Either party may terminate this Agreement at any time by providing written notice.
The Brand will pay all valid commissions earned up to the termination date.

7. Independent Contractor

The Influencer participates as an independent contractor, not an employee or agent of the Brand, and is responsible for their own taxes and liabilities.

8. Compliance & Legal

The Influencer must comply with all FTC, FDA, and applicable advertising regulations.
Any misleading or non-compliant content may result in forfeiture of commissions or termination.
The Brand is not responsible for any tax obligations or liabilities incurred by the Influencer.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

By signing and submitting this form, the Influencer acknowledges that they have read, understood, and agree to be bound by the terms and conditions of this Independent Affiliate Agreement.

A digital signature or submission of this form shall be deemed equivalent to a handwritten signature for all purposes.
